TERMS AND CONDITIONS FOR SPECIAL EVENT TICKETS

1. DEFINITIONS
In these Terms, the following definitions apply:
“Booking” means the reservation or purchase of Ticket(s) for a Special Event, whether made online, by phone, or in person.
“Club” means West Bromwich Albion Football Club Limited (Company Registration Number 03295063) of The Hawthorns, West Bromwich, West Midlands, B71 4LF.
“Customer” means the individual making the Booking and/or any person included in that Booking.
“Special Event” means any event organised, hosted, or otherwise made available by the Club at the Venue for which a Ticket must be purchased, other than professional football matches or hospitality connected with such matches, stadium tours, and private functions booked as a package. “Special Events” include, but are not limited to, charity events, concerts, exhibitions, Festive Party Nights, Christmas Party Drinks, the Junior Baggies Christmas Party, the 125 Historic Dining Experience, and the Club Awards Dinner.
“Terms” means these Terms and Conditions together with the Ground Regulations (available on the Club’s website at www.wba.co.uk or displayed at The Hawthorns Stadium).
“Ticket” means any physical or digital ticket issued by or on behalf of the Club by email, via a mobile app, or through a secure web link, granting entry to a Special Event.
“Venue” means The Hawthorns Stadium or any alternative venue used for the Special Event.
2. AGREEMENT TO THESE TERMS
2.1 These Terms apply to all Special Event Tickets purchased from or via the Club and take precedence over any other terms.
2.2 By purchasing a ticket, the Customer accepts these Terms on their own behalf and on behalf of all persons included in the Booking.
2.3 Where the Customer purchases a Ticket for another person, they confirm they are authorised to accept these Terms on that person’s behalf.
2.4 All warranties and conditions implied by statute or common law are excluded to the fullest extent permitted by law.
3. TICKETS AND DELIVERY
3.1 Tickets may be issued in physical, electronic, or digital form.
3.2 The Customer is responsible for ensuring:
(a) accurate and up-to-date contact details;
(b) access to their email account and/or Club-approved app; and
(c) security of their Ticket.
3.3 The Club is not responsible for any Ticket that is lost, deleted, corrupted, or not received due to factors outside the Club’s control, including spam filtering or incorrect contact details.
3.4 Tickets may not be copied, forwarded, resold, or transferred except through a Club-approved method. Unauthorised resale or duplication may result in cancellation without refund.
3.5 Customers may be required to present valid photographic identification on entry at the Venue.
4. CUSTOMER ACCESS AND OBLIGATIONS
4.1 Customers must be aged 18 years or over to purchase a Ticket.
4.2 Under-18’s may only attend a Special Event if they are accompanied by a responsible adult who also holds a valid Ticket.
4.3 A Ticket does not confer any right of renewal or priority access to future events.
4.4 Access is restricted to areas designated for the Special Event.
4.5 Customers must comply with all Club policies, instructions, and searches.
4.6 Customers must not:
(a) bring animals into the Venue (except assistance dogs as defined by the Equality Act 2010);
(b) bring food or drink (including alcohol) into the Venue unless permitted;
(c) engage in illegal, unsafe, or disorderly conduct;
(d) display signage or promotional material without the Club’s prior written consent;
(e) cause a nuisance, annoyance, inconvenience, or disturbance to the Club or to other persons who may be using the Venue or local residents living around the Venue;
(f) breach any applicable laws, safety protocols, or public health requirements; or
(g) take photographs or recordings except for private, non-commercial use and not in restricted areas.
4.7 Personal belongings are brought at the Customer’s own risk. The Club may refuse or confiscate prohibited items.
4.8 Late arrival may result in refusal of entry without refund.
4.9 The Club may refuse admission or remove a Customer for breach of these Terms or on safety/security grounds. The Club may also exclude such individuals from future Club events, notify the police, or pursue appropriate civil remedies.
4.10 The Customer shall indemnify the Club against all losses, damages, and costs arising from their breach of these Terms.
5. PRICE AND PAYMENT
5.1 Ticket prices are as advertised at the time of purchase and include VAT where applicable.
5.2 Payment must be made using methods accepted by the Club.
5.3 The Club may refuse or cancel any Booking at its discretion.
6. CHANGES OR CANCELLATION BY THE CLUB
6.1 The Club reserves the right to alter the advertised programme, timings, content, layout, or running order of any Special Event where reasonably required.
6.2 The Club may alter, postpone, or cancel a Special Event due to operational, safety, or Force Majeure reasons.
6.3 The Club will notify Customers where practicable using the contact details provided.
6.4 If the Special Event is cancelled, Customers will receive either:
(a) admission to a rescheduled or alternative event (if available); or
(b) a refund of the Ticket price.
6.5 Refunds exclude ancillary expenses such as travel or accommodation.
6.6 Refunds will be issued only to the original purchaser.
6.7 In the event of a Force Majeure event, the Club shall not be liable for delay or non-performance, but if no alternative date is available within 12 months, a refund will be issued.
7. CANCELLATION OR AMENDMENT BY CUSTOMER
7.1 Due to the nature of Special Events and the fact that Tickets are for a specific date and time, Customers do not have a statutory right to cancel their Ticket.
7.2 Refunds or exchanges will only be offered if the Special Event is cancelled by the Club.
7.3 If a Customer requests to change their Ticket to an alternative date or Special Event before the original event occurs, the Club will use reasonable endeavours to accommodate the request, subject to availability, but no guarantee is given. The Club shall not incur liability if a change cannot be arranged.
7.4 Any refund or exchange approved by the Club will be made using the same payment method used to purchase the Ticket, unless otherwise agreed in writing.
8. REFUSAL OF ADMISSION AND REMOVAL
8.1 The Club may refuse admission to, or remove, any individual who:
(a) is subject to a banning order(whether issued by the Club, police, courts or governing body);
(b) has previously been removed or excluded from Club premises;
(c) poses a risk to the safety, security, or enjoyment of others;
(d) engages in or is reasonably suspected of engaging in anti-social or abusive behaviour;
(e) is found in possession of prohibited, dangerous, illegal, or restricted items;
(f) refuses necessary searches;
(g) appears intoxicated or under the influence of drugs; or
(h) has provided false or misleading information.
8.2 No refunds will be issued where admission is refused under this clause 8 unless required by law.
9. CONDUCT AND SAFETY
9.1 Customers must comply with all safety rules and staff instructions.
9.2 The Club may conduct searches of persons or belongings.
9.3 Prohibited items include (non-exhaustive): weapons, pyrotechnics, fireworks, alcohol, illegal substances, glass, and any item deemed unsafe.
9.4 The Club may refuse entry to any person attempting to bring prohibited items.
9.5 Parking at or near the Venue is entirely at the vehicle owner’s and/or driver’s own risk. The Club does not accept any responsibility or liability for:
(a) the safety or security of vehicles;
(b) loss of, or damage to, any vehicle or its contents; or
(c) any injury occurring in connection with parking or movement of vehicles,
except where caused directly by the Club’s negligence. The Club does not guarantee parking availability and may restrict access for operational or safety reasons.
10. LIMITATION OF LIABILITY
10.1 Nothing excludes the Club’s liability for:
(a) death or personal injury caused by negligence;
(b) fraud or fraudulent misrepresentation; or
(c) any liability that cannot legally be excluded.
10.2 Subject to clause 10.1, the Club is not liable for:
(a) loss, theft, or damage to personal property;
(b) indirect, special, or consequential losses;
(c) loss of enjoyment; or
(d) travel, accommodation, or subsistence costs.
10.3 The Club’s total aggregate liability is limited to the Ticket price paid.
11. FORCE MAJEURE
11.1 The Club is not liable for delay or failure to perform its obligations due to events beyond its control, including but not limited to severe weather, power failure, national emergencies, epidemics, civil disorder, industrial action, or government restrictions (“Force Majeure”).
11.2 In such circumstances, the Club will use reasonable endeavours to reschedule the Special Event or provide a refund.
12. DATA PROTECTION
12.1 Personal data is processed in accordance with the Club’s Privacy Policy, which is available at www.wba.co.uk/privacy-policy.
12.2 By purchasing a Ticket, Customers consent to the use of their personal data for ticketing, safety, and event management purposes.
13. RECORDINGS AND IMAGES
13.1 CCTV and recording equipment may be in use at the Venue for safety, security, operational, and promotional purposes.
13.2 By attending a Special Event, the Customer consents to being photographed, filmed, or recorded, and to the Club’s lawful use of such material without payment.
14. GENERAL
14.1 Tickets are personal, non-transferable and may not be resold, transferred, or used for commercial purposes without the Club’s prior written consent.
14.2 Tickets purchased from unauthorised sellers or third-party websites are invalid.
14.3 The Club may assign or subcontract its rights and obligations under these Terms at any time.
14.4 The Club may amend these Terms from time to time. The version in force at the time of purchase applies.
14.5 These Terms constitute the entire agreement between the Customer and the Club relating to Special Event Tickets.
14.6 No person other than the parties has any rights under the Contracts (Rights of Third Parties) Act 1999.
14.7 If any provision in these Terms is found to be unlawful or unenforceable, the remaining provisions shall remain in full force and effect.
15. GOVERNING LAW AND JURISDICTION
15.1 These Terms and any disputes arising in relation to them shall be governed by and interpreted in accordance with English law.
15.2 The courts of England and Wales shall have exclusive jurisdiction.
